Welcome to Touched by Harry Potter (the "Site"). By visiting the Site or submitting a story, you agree to these Terms & Conditions (the "Terms"). If you do not agree, please do not use the Site or submit a story.

1. An unofficial fan project

The Site is an independent, non-commercial fan project created solely to collect personal reflections, commentary, and fan expression regarding the ways the Harry Potter stories have impacted readers. It is not official and is not affiliated with, authorised by, endorsed by, sponsored by, or connected to Warner Bros. Entertainment Inc., J.K. Rowling, Wizarding World, or any other rights holder or licensee.

Stories, opinions, and personal experiences published on the Site belong to their individual authors and do not represent any rights holder or person associated with the Harry Potter franchise.

2. Trademarks, copyright, and fair use

HARRY POTTER and related character names, titles, logos, artwork, images, dialogue, and other protected elements belong to their respective owners. The Site does not claim ownership of any third-party intellectual property. All references to protected elements are made strictly for non-commercial fan appreciation, commentary, review, and personal expression under applicable fair use or fair dealing principles.

Do not submit quotations, book or film passages, images, artwork, music, dialogue, or other material that you do not have the legal right to share.

3. Notice and Takedown Policy (Rights Holders)

If you are a rights holder (including Warner Bros. Entertainment Inc., J.K. Rowling's representatives, or associated entities) and believe that any content published on the Site infringes your copyright, trademark, or other intellectual property rights, please contact us immediately using the contact details in Section 13.

Upon receiving a notification with sufficient detail to identify the material, the operator will review the request promptly and, where appropriate, disable access to or remove the relevant content in good faith.

4. Non-commercial status

The Site operates as a non-commercial personal fan project. It does not charge for submissions, and submitting a story does not create a right to payment or royalty. If the Site's commercial status changes in the future, these Terms and all relevant disclosures will be updated before any change takes effect.

5. Submitting your story

Submitting a story is voluntary. You retain ownership of your original writing. By submitting a story, you grant the Site operator a non-exclusive, worldwide, royalty-free, perpetual licence to store, review, reproduce, format, edit (for spelling, length, clarity, or sensitivity), publish, display, and promote the story across any digital media, channels, or future formats directly associated with this project.

A published story will display only the name or nickname you choose to provide, and never your email address.

6. Review, publication, and removal

Submissions are moderated and are not published automatically. The operator reserves the right to accept, reject, delay, format, lightly edit, add content/trigger warnings, unpublish, or remove any submission at any time at sole discretion. Sending a story does not guarantee publication, a reply, or continued availability.

You may request removal of your published story using the contact method in Section 13. Once your request is verified, the operator will remove controlled copies within a reasonable timeframe. Copies already cached, archived, saved, or shared by third parties outside the operator's direct control may remain accessible.

7. Privacy and personal information

The Site collects information you voluntarily provide through the submission form, including a display name or nickname, an optional email address, your story, and required confirmations.

This information is used solely to process submissions, contact you regarding your story if needed, handle removal requests, secure the Site, and comply with legal requirements. Email addresses are kept strictly private, are never published, and are not used for marketing.

Please do not include health information, government identification numbers, financial details, precise residential addresses, or other sensitive personal information within your submitted story.

8. Age requirement

Anyone may read the public Site, but story submissions are strictly limited to individuals aged 18 or older. By submitting a story, you confirm that you meet this age requirement.

9. Site availability and medical/mental health disclaimer

The Site and its content are provided "as is" and "as available" basis. The operator makes no warranties regarding uninterrupted access, accuracy, or security.

Personal stories published on the Site reflect individual experiences and do not constitute medical, mental health, legal, or professional advice.

10. Limitation of liability

To the fullest extent permitted by law, the operator shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Site, reliance on its content, or the submission and publication of a story.

11. Changes to these Terms

These Terms may be updated periodically to reflect changes to the Site or legal requirements. Updates take effect immediately upon posting, indicated by the date at the top of this page.

12. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Israel, without limiting mandatory local consumer or privacy protections applicable in your jurisdiction. Any disputes shall be submitted to the competent courts of Israel.
